What a gym waiver template needs to cover
A gym liability waiver protects your business when members use equipment, attend classes, or train on their own. Most fitness facility waivers follow the same basic structure: a description of activities, a health acknowledgment, an assumption-of-risk clause, and a liability release. The template below covers all four.
Why gyms and fitness studios need a signed waiver
Every person who walks into your facility is accepting some level of physical risk. Free weights, cable machines, treadmills, group classes, open floor space. A signed waiver makes the signer aware of those risks before they start and gives your business a documented record that they accepted them voluntarily. Without one, you're relying entirely on general liability insurance.
What this template includes
The template has eight numbered sections. It opens with a description of the activities your facility offers (open gym, strength and conditioning, cardio, group classes) so the signer understands what they're agreeing to. From there it moves into a health and medical fitness acknowledgment, where the signer represents that they're physically able to participate or have chosen to participate despite known limitations.
The assumption-of-risk section names specific hazards: strains, sprains, falls, equipment failure, and collisions. The release and waiver section covers the liability release itself. There are also sections for emergency medical authorization, rules and equipment conduct, an optional photo and video consent clause, and a governing law acknowledgment.
Customizing this for your facility
This is a starting point, not a finished document. If your gym runs specialized programs like CrossFit classes, HIIT circuits, powerlifting open gym, or personal training sessions, you should add language that describes those specific activities and their risks. The more precisely the waiver reflects what actually happens in your facility, the more useful it is if it ever needs to hold up.
You should also have this reviewed by a licensed attorney in your state. Waiver enforceability varies by jurisdiction, and certain clauses may need specific language to be valid where you operate.

2. Health and Medical Fitness Acknowledgment
I represent that I am physically able to participate, or have chosen to participate despite any known limitations. I understand that I should obtain medical advice before participating if I have concerns about my health, condition, or readiness for exercise.
3. Rules, Equipment Use, and Staff Instructions
I agree to follow posted rules, use equipment only as intended, and comply with staff instructions regarding safe participation. I understand that unsafe behavior or misuse of equipment may increase the risk of injury.
4. Assumption of Risk
I understand that use of a gym or fitness studio involves inherent risks, including strains, sprains, falls, equipment failure, collisions, and other serious injuries. I voluntarily accept and assume all such risks to the extent permitted by law.
5. Release and Waiver of Liability
In consideration of being allowed to participate, I release and hold harmless the business, its owners, employees, contractors, and affiliates from claims arising out of my participation or use of the facility, except to the extent prohibited by law.
6. Emergency Medical Treatment Authorization
If I am injured or require medical attention, I authorize staff to contact emergency services and share relevant information as reasonably needed to respond to the situation.
7. Photo and Video Consent (Optional)
I understand that the business may request permission to use photographs or video taken during classes, events, or facility use for operational or promotional purposes.
8. Governing Law, Venue, and Acknowledgment of Understanding
I acknowledge that I have read this document, understand its purpose, and agree that it is intended to be interpreted as broadly as permitted under applicable law.
